Planned corporate succession concerns the transfer of an owner-managed company to suitable successors, who are usually family members, but may also be external parties. This form of business succession usually requires medium to long-term planning.
Unplanned business succession, on the other hand, is when succession occurs through unexpected events such as illness or death.
For both types of business succession, early individual advice and structuring is essential. This applies, for example, with regard to the appropriate drafting of the articles of association, coordinated testamentary dispositions or also a “legal emergency case”, which can contain, for example, precautionary powers of attorney or living wills to safeguard the company.
