Law in House 7: Care check

We offer a care check, usually lasting one day, with regard to typical errors in contracts and fee increases. The aim of this service is to identify any need for action. We tell you where you should take action. The complete legal review and, if necessary, revision of your forms, sample contracts and internal processes can then take place at a later date.

Regulations in outpatient care contracts are also repeatedly the subject of court decisions.

In assisted living – if the mandatory application of the WBVG and the Sächsisches Betreuungs- und Wohnqualitätsgesetz (SächsBeWoG) is to be avoided – care must be taken to ensure that tenancy agreements are only linked to support services and not to outpatient care services.

We offer you a generally one-day care check with regard to typical errors in contracts and pay increases. The purpose of this offer is to identify any need for action. We will tell you where you should take action. The complete legal review and, if necessary, revision of your forms, sample contracts and internal processes can then take place later.

For this care check, you provide us in step 1 in advance (e.g. by sending us an e-mail) with the information and documents that we should check for any current need for action. We then check this information and documents (usually within a time frame of around 4 hours) for any need for action – a complete legal review and revision of the documents does not yet take place within this framework (this complete legal review/revision is offered separately if required).

This may include the following information/documents:

  • For inpatient care: residential and care contract, care home contract, contract for fully inpatient care facilities, facility contract for fully inpatient care, day care contract (contract for day care facilities), short-term care contract
  • Fee increase letter in the area of inpatient care in accordance with the WBVG
  • Care contract for home (outpatient) care
  • Service/support contracts (sometimes also referred to as care contracts) for assisted living

 

In step 2, we will come to your company (usually for a further 4 hours) to discuss with you any need for action and how to proceed. You can then decide for yourself whether you would like to work out a solution yourself using the information gained during the care check or whether you would like to take advantage of legal advice and support from us that goes beyond the care check. In the latter case, we will be happy to provide you with a customised offer.

Cost of this comprehensive care check: By arrangement. The fee depends on the desired scope of the care check in terms of content and time.
